Obtaining a license is fairly simple. Fill out the application form from the PACA website, and send it to the appropriate regional office with the fee. It’s a good idea to call the regional office first to make sure the amount of the fee is correct.
The application is signed under penalty of perjury, and there are significant penalties for filing an application with false information.
The application requires persons who are partners, or who are officers, directors, and shareholders in a corporation, or who are members or managers in an LLC, be named in the application. There are significant liabilities for such persons if the company is found to have violated PACA. These include: restrictions on future employment or licensing; and individual liability for unpaid produce debts. See Responsibly Connected Cases and Individual Liability under The PACA Trust. A person should consider these potential liabilities before agreeing to be named to such positions in a produce company, and contact PACA or an attorney if there are questions about this.
