PACA will not issue a license if it believes the application is a ruse to obtain a license so a restricted person can continue to operate the company. (See Responsibly Connected Cases for information on restricted persons.)
An example of such a ruse is when a restricted person has a spouse or child obtain a license, but continues to run the business in the background. PACA scrutinizes these applications, and sometimes conducts an investigation to determine if the restricted person is involved in the business. If PACA finds the restricted person is involved in the business, PACA either denies the license application, or moves to revoke the license if it was already issued.
